When I played a lot of online bridge I discussed it with my pd (after some disaster in 1H p 4H p p d sequence). We estabslihed that dbl is t/o if they bid and jump raise hearts and penalty if their suit is spades.

I play this double for take out.
Perhaps penalty advocates expect agressive preempts and raises from opponents. Such as opening weak 2 with 5 cards or raising with Hx. But this work other way arround too. Suppose your pd has a lot of values but did not act due to his heart length over 3♥
In principle, whenever i am on pass out seat, i feel i have an obligation to reconsider the situation. Opponents have a fit and they stayed in partscore, i have a perfect take out double shape but i could not act previous round because i am too weak for this.

I know my example is optimistic, but i don't think making a delayed t/o double can go wrong in the long run, with perfect t/o shapes in this situation, for various reasons. It also takes a lot of pressure off from our pd, who otherwise would feel that it is his last chance to make a move after 3♥, with a lot of flawed hands, and will have to make an early choice.
